New Terms
Becoming an Asia Pacific employment marketplace
We have recently announced that our SEEK, JobStreet by SEEK and JobsDB by SEEK websites will become an Asia Pacific employment marketplace. This evolution is occurring in phases:
JobStreet by SEEK Philippines joined the SEEK ANZ platform in October 2023;
the remaining JobStreet markets (Singapore, Malaysia and Indonesia) joined the SEEK ANZ platform in November 2023; and
JobsDB by SEEK (Hong Kong and Thailand) will transition to the SEEK ANZ platform on or about 21 January 2024.
After the third phase, all ads posted by hirers using JobsDB, JobStreet and SEEK in all 8 countries will appear in relevant searches on all websites and apps.
Updates to our online terms and Privacy Policy
As part of this process, we have updated our online terms, including our Privacy Policy. Please note that many of the updates will not be relevant to you unless you access the new or expanded products / services that will be available through the new Asia Pacific employment marketplace. For example, there will be specific terms that only apply where you post an ad for a role located outside of your country.
Below is a summary of the key changes:
We have a new section titled “Fair use and appropriate conduct” (starting at clause 62 of the Advertising Terms of Use). This section has been included for a few reasons:
To clearly outline key situations in which we may need to take action to protect our candidates, other hirers and the SEEK Group (for instance, if there is a security threat). We must be reasonable in making any decisions.
Our single online technology platform will provide the benefit of posting ads for roles located in other countries across our APAC employment marketplaces. However, we still expect that hirers will post the vast majority of their roles in their contracting country, which is reflected in clauses 63 and 64.
We expect all hirers to use our products and services in the way we intend. In the event this does not happen, we will notify the hirer of the improper use (if that is appropriate). If the hirer continues to improperly use our products and services, we are able to take steps to remedy and prevent the improper use.
Reinforcing that inappropriate conduct towards our staff has never been acceptable and won’t be tolerated.
We have included a right for you to dispute any of the decisions we make under these clauses and we are required to consider your dispute promptly and in good faith.
Please be aware that the laws of other countries may apply to you when using the APAC employment marketplace. For example:
If you access personal information / data of a candidate from another country, you must comply with the privacy laws of that country as if you were regulated by such privacy laws.
Hiring Filipino based candidates for roles located outside that country may be regulated.
We will be extending the period during which you can access historical candidate application data (which includes resumes, cover letters and other application documents) and job content data in your hirer account to 3 years. This change in policy will occur from 31 March 2024.
As per our previous Advertising Terms of Use, further obligations apply to you if you are utilising an API solution. Please be aware that the revised API related terms will apply to both you and your API partner if you access the SEEK API (if applicable). A link to these updated SEEK API terms can be found within the Advertising Terms of Use (see link above). If you already directly access a SEEK API without the use of an API partner, we will contact you separately with further information.
Our products and services (and their respective terms) will vary according to location. We encourage hirers to review the terms applicable to their country and other locations that may be relevant (e.g. if a hirer posts an ad for a role located in another country).
The new terms better reflect the products and services we offer, both now and in the future.
We have taken the opportunity to refresh the terms to make them easier to understand.
Standard Talent Search
Standard Talent Search is a new, complimentary offering for JobStreet by SEEK and JobsDB by SEEK hirers and will be subject to these new terms.
When posting a job ad, hirers will receive recommendations of up to 100 candidate profiles that we believe match their requirements plus complimentary credits that can be used to connect with candidates (send message / invite to apply / download Profile or CV). This is known as “Talent Search”.
Complimentary credits will not be granted to hirers with “Premium Talent Search” (see below).
Premium Talent Search Please note that the changes below may not be applicable to all users or situations. If a change is not relevant to your specific circumstances, please feel free to disregard it.
The paid Talent Search service currently offered by JobStreet by SEEK and JobsDB by SEEK will now be known as “Premium Talent Search” and will be governed by new, standalone terms which replace the previous terms which were set out in the Product Terms & Conditions.
In terms of the service itself, the experience will be enhanced for hirers, with new connection methods and greater candidate reach. Candidates will only be surfaced in markets that match their ‘home’ or ‘prefer to work’ locations.
If a hirer runs low on talent search credits, there will be a default auto credit top up to the value of 10% of the Ad Budget amount, which will be charged to the hirer. You may contact your Account Manager to turn off this auto credit top up feature (please do so before an auto top up occurs). Auto credit top up does not apply to Premium Talent Search Packs (i.e. when Premium Talent Search is purchased independently of an Ad Budget) or to agreements entered before 21 January 2024.
We will be simplifying our Privacy Policy and aligning it across our three brands (SEEK, JobStreet by SEEK and JobsDB by SEEK) as we become an APAC employment marketplace. We want to make sure that you understand how your information is collected, used and protected when you use our services. One key update within the new Privacy Policy is the provision of greater clarity on which legal entity in the SEEK Group is responsible for the personal information we collect from you.
We encourage you to read our new Privacy Policy in full before it comes into effect. If you continue to use our new platform, products and services after this date, you’ll be agreeing to the new Privacy Policy.
Thank you for taking the time to read through the summary of these changes to our terms.
